By Rikki Kirzner Contributing Writer Domain and internet watchdog groups across the country have been holding intense discussions and heating up the keyboards to alert the domaining industry about the inherent threats hidden within the Anti-Phishing Consumer Protection Act of 2008 (APCPA).
Introduced on Feb. 25, 2008 by U.S. Senator Olympia Snowe and cosponsored by Senators Bill Nelson (D-FL) and Ted Stevens (R-AK) the bill is not quite what its title would have you believe. APCPA is a Trojan horse with all the earmarks of an attempt by special interest groups and/or certain corporations to wrest legal domain names away from domainers by imposing a new, tougher, and unfair type of infringement that goes beyond trademark law and eliminate domainers’ right to privacy under the guise of providing enforcement of anti-phishing laws. |

With the exception of the typosquatting and parking claims, all counts of the Vulcan Golf, LLC (vulcangolf.com) class action lawsuit against Google (Google.com), Oversee.Net, Sedo (Sedo.com), Dotster, (Revenuedirect.com), and Internet Reit (Ireit.com) were dismissed by Judge Blanche M. Manning on March 20.
The golf club manufacturer’s $1,000,000 putative class action lawsuit filed in June 2007 alleges trademark infringement violations under the Anticybersquatting Consumer Protection Act (ACPA) and Racketeer Influenced and Corrupt Organizations Act (RICO). In other words, Vulcan Golf claimed its named defendants engaged in a “massive scheme to use deceptive domain names on the internet to generate billions of advertising dollars at their expense.” |

Domainers Must Ride Waves of Advertising Changes or Wipe Out By Rikki Kirzner Contributing Writer
A wave of change in advertising, domain tasting, domain kiting, and Google policies threaten to capsize common domaining practices and wipe out domainers who are unprepared or unwilling to use these changes to their advantage.

It looks like IDNs will be coming to a registrar near you in the not too distant future.
The launch of IDNs, or international domain names, topped the list of priorities proposed by ICANN (the Internet Corporation for Assigned Names and Numbers) and posted to its site Oct. 19.
ICANN, which is the nongovernmental authority over the Internet's domain name and IP systems, based its five priorities on dialogues it had with representatives of Internet stakeholders during the organization’s June meeting in San Juan.
The plan is open for comment through Nov. 10 and is expected to be adopted by ICANN’s board in December.
The other four priorities named in the plan were “continuing to improve core operations,” “strengthening ICANN’s multi-stakeholder model to manage increasing demands and changing needs,” “enhancing security and stability of the Internet’s unique identifiers,” and “strengthening accountability and governance.”
